I am writing to formally lodge a complaint against Livspace for their unfair and misleading business practices.

During my initial inquiry, their team explained the terms and conditions of their services in a particular way. Trusting their promises, I paid a registration amount of 40k. However, after receiving the payment, Livspace completely altered the terms. Despite my concerns, I proceeded in good faith based on assurances from their first project manager, @Anrindan Show, who clearly stated that the registration amount would be adjusted against any purchase.

Later, a new project manager, @Aakriti Ghose, informed me that the 40k adjustment was only possible if I made a minimum order of 2lakhs. When I explained my discomfort with this new term and requested that my amount be adjusted against any product purchase, she stated that it wasn’t possible. I was further informed that if I did not make the minimum order, my 40k would be forfeited.

This change in terms after payment was unethical and left me feeling defrauded. Livspace has refused both a refund and an adjustment, resulting in significant financial distress. Upon investigating their service portal, I discovered numerous similar complaints from other customers about their practices.

Livspace’s deceptive advertisements do not align with the reality of their services and customer support. I believe this is a deliberate and recurring issue and must be addressed to protect other customers from being misled.

I request that the relevant authority investigate this matter and hold Livspace accountable for their actions. Additionally, I urge that measures be put in place to ensure transparency, fairness, and better customer service in the future.

Under the Consumer Protection Act, 2019, particularly Section 2(11), "deficiency" is defined as any fault, imperfection, shortcoming, or inadequacy in the quality, nature, or manner of performance required to be maintained by or under any law or contract. The actions of Livspace, as described, constitute a deficiency in service.

1. Brief averments of the complaint are as follows:


The case of the complainant is that he is absolute owner of a house property bearing villa no.135 at Bachupalli, Medchal-, Malkajagiri district and intended to do interior work for his house and contacted opposite party no.1l in the month of August 2018, whose technicians visited the house and after taking measurements, agreed to complete the interior work, which includes false ceiling, wardrobes in all three bedrooms, TV partition, modular kitchen, staircase, storage, etc. for a total amount of Rs. 15,19,135/- and also assured that the total work would be completed within 45-60 days.

The complainant paid initial payment of Rs. 1,39,000 on 31-10-2018, Rs. 2,00,000/-Rs.1,97,548 and Rs. 2,23,020 on 1-2-2019, Rs. 1,11,510 on 18-5-19, Rs. 1,11,510 on 30-7-2019 and Rs. 1,36,548, Rs. 2,00,000 and Rs. 2,00,000 on 21-11-2019, total amount of Rs. 15,19,136/- was paid to the opposite parties. All the transactions were done online and the opposite party issued receipts for the same.

The opposite parties has given a copy of the complete project details which included the details of the project, scope of work, floor plan design and bills of quantity and started the interior work in the month of March 2019, but the opposite party has not completed the interior work within the stipulated period of 60 days. In the month of June 2019, the complainant observed some differences in the TV partition and immediately informed the opposite party who assured that they will immediately rectify the problem.

The doors of the washroom were described as sliding doors in the plan and the bill was calculated and paid for the same but installed a normal push type door. The complainant had to pay extra amount to a third-party vendor in order to finish the false ceiling work to the extent of Rs. 40,000/-. The opposite party though started the work in March 2019 and promised to finish the work by 8-9-2019 but on the said date did not hand over the house and stated that they lack manpower and technician to complete the work and promised to complete the work by 17-10-2019. Later they again postponed to 23-12-2019 but not finished the interior work till date.

Though wardrobes and modular kitchen is completed is completely different from the original plans and also damaged one of the two phases of electricity and the semi-finished interiors already started to break and the materials used were not of good quality. The father of the complainant who is a senior citizen and suffering with Heart problems and visiting the house for daily inspection also suffered health problems due to the inaction of the opposite parties.

Therefore, the complainant is unable to utilize the house due to incompleteness of the interior works and could not give the house for rent and suffered huge financial loss. The improper service of the opposite parties amounts to deficiency in service and unfair trade practice. Hence, this complaint.

ORDER

i) To pay Rs.1,07,426/- (Rupees One Lakh Seven Thousand Four Hundred and Twenty Six only) with 9% Interest p.a from 31.01.2020 to till its realization

ii) To pay Rs.10,000/- (Rupees Ten Thousand only) towards costs of the complaint. Time for compliance is 45 days from the date of receiving copy of this order failing which, the amount of Rs.1,07,426/- carries 12% interest p.a. till its realization.
