In the Matter of: Fees refund



1. Facts of the Case:


a. I, the Complainant, had applied for admission to a program at Jagdish Sheth School of Management (JAGSOM), Bangalore. I paid an amount of ₹550,000 as part of the admission process.


b. The offer letter provided by the Opposite Party stated a clear withdrawal and refund policy. It explicitly mentioned that all withdrawal requests, if any, must be made before July 5th.


c. Acting in accordance with this policy, and well before the stated deadline, I sent a formal withdrawal request via email on May 31st. I sent subsequent follow-up emails on June 9th and June 10th to ensure my request was received and processed.


d. It is important to note that I never formally registered for the program or attended any classes. My withdrawal was submitted before the program's registration period had even concluded.


e. In response to my withdrawal request, the Registrar of JAGSOM, Bangalore, informed me via email that I would not be receiving any refund.


f. The Opposite Party's denial of my refund is based on a contradictory policy mentioned on their website, which states that refunds will not be issued for requests submitted before July 3rd. This policy is confusing, misleading, and directly conflicts with the July 5th deadline stated in my official offer letter.


2. Grounds for Complaint:


a. The Opposite Party has committed a deficiency of service by failing to provide the service (the program) despite accepting the fee, and by unjustly withholding the amount of ₹55,000 even after I followed the withdrawal procedure as mentioned in my offer letter.


b. The contradictory deadlines in the offer letter and on the website constitute an unfair trade practice. This has caused me financial loss and mental harassment.


c. The Opposite Party is wrongfully holding my money despite me following all the specified procedures and withdrawing my application in a timely manner.


3. Relief Sought:

a. Immediately refund the full amount of ₹55,000 to me.

You need to file a case in the Consumer Forum to get the Refund.
