I state that I had availed a housing loan from SBI bank on 29th October 2024 for purchase of a residential flat being Flat No. 3A, Premises no 24-271 in street no 271, Block DD92, AA1D Newtown 700156. Before sanctioning the loan, SBI bank have verified all mandatory documents, conducted title search, and completed legal scrutiny through SBI's empaneled advocate. After being satisfied with the documents, the loan was sanctioned.

The said flat was registered on 13th November 2024 through the competent court Office of the D.S.R - III South 24-parganas, West Bengal and I, thereafter obtained possession and have been residing in the same.

However, I have recently been served with a Title Suit filed by certain landowners claiming ownership over the said flat. They have alleged that the developer had no authority to sell the flat and that the transaction/ Registration of Sale deed is illegal. The matter is now sub judice.

I state that I am a bona fide purchaser who relied entirely upon the due diligence and legal verification conducted by SBI bank before sanctioning the loan. Being a nationalized and reputed financial institution, SBI bank is expected to conduct thorough verification of title and encumbrances before financing a property.

Despite the title dispute, I am continuously paying EMIs to the bank. However, if ultimately the title of the property is declared invalid or I lose possession, all the EMIs paid by me would become futile and irrecoverable. I would be left without the property and yet burdened with loan liability. This situation has arisen solely due to the failure of the bank to ensure clear and marketable title before sanctioning the loan.

The loan was sanctioned despite incomplete or defective legal scrutiny. This amounts to gross negligence and clear deficiency in service on the part of the bank.

Therefore, I most respectfully pray that this Hon’ble Consumer Commission be pleased to admit and register the present complaint against State Bank of India and take appropriate action in accordance with law.
