The complainant placed an order for a two-pack of HK Vitals Skin Glutathione, expecting to receive two properly sealed and unused bottles in accordance with the product description and the order placed.
The order was delivered to the complainant's shop/business premises on hiphopz brandfactory kalathypadi kottayam
The delivery location was the complainant's shop, where CCTV cameras are installed and operational.
At the time of delivery/opening of the package, the complainant noticed that one of the two bottles was not in proper sealed condition.
The seal of one bottle was found opened/broken, and approximately half of the contents of the bottle were missing.
The complainant states that the product was expected to be delivered in an intact, properly sealed and unused condition. Receiving a bottle with a broken seal and a substantial quantity of the contents missing constitutes a serious deficiency in the product/order fulfilment and has caused financial loss, inconvenience and concern to the complainant.
Importantly, the delivery and the opening of the package took place at the complainant's shop, where CCTV cameras were operating.
The CCTV footage records the relevant events concerning the receipt and opening of the package. The complainant has preserved the relevant CCTV footage and is willing to produce the same before the Hon’ble Commission as evidence.
The complainant did not expect or consent to receive a product that had already been opened or that had approximately half of its contents missing.
The complainant immediately contacted the seller/platform/customer-care service regarding the issue and requested a proper resolution, replacement/refund and/or investigation.
Despite bringing the matter to the notice of the concerned parties, the complainant has not received a satisfactory resolution.
The complainant submits that the failure to deliver the product in the condition in which it was ordered amounts to deficiency in service and/or unfair trade practice, as applicable, and the complainant is entitled to appropriate relief under the Consumer Protection Act, 2019
