Dear Members,
I am seeking legal guidance regarding a dispute with Ola Electric Technologies Pvt. Ltd. involving false assurances, lack of transparency, and non-refund of the 162608 I paid
An Ola Electric scooter was booked on 9 January 2026 in the name of my father, Fayaz Ahmad Wani. The booking was made only after repeated assurances from the dealer that the vehicle would be delivered within a reasonable time. At the time of booking, no clear or written delivery timeline was disclosed.
After the payment was made (the time ,when to make the payment was also told by the dealer), we repeatedly contacted Ola Electric through phone calls and emails seeking confirmation of delivery. Unfortunately, there has been no clear, consistent, or timely response from the company. Emails either remained unanswered or received generic replies that did not address the issue.
Additionally, we contacted the dealer multiple times over the phone and repeatedly made assurances regarding delivery on specific occasions. These promises were not honored, and no prior or official communication was provided regarding delays or revised timelines.
Due to continuous false assurances, lack of transparency, and absence of reliable information, we requested cancellation of the booking and refund of the amount paid. However, despite repeated follow-ups, the refund has not been processed till date.
This conduct appears to constitute deficiency in service and unfair trade practice, as the booking was obtained through misleading assurances without proper disclosure of delivery timelines. The repeated but unfulfilled promises, coupled with inadequate response through official communication channels, have caused mental harassment and financial inconvenience to my family.
I respectfully request guidance from experienced members and legal professionals on:
1. Appropriate legal remedies under the Consumer Protection Act
2. Whether repeated false assurances strengthen the case for unfair trade practice
3. Whether issuing a legal notice prior to filing a consumer complaint is advisable
4. The appropriate consumer commission having jurisdiction in this matter
All relevant documents, including booking receipt, payment proof, and communication records, are available.
