Respected Sir/Madam,
I, Saket Karn, resident of Moradabad (U.P.), wish to lodge a formal complaint against Livspace India Pvt. Ltd. and its authorized dealer Eleven Associates, located at Delhi Road, Moradabad, for cheating, misrepresentation, and refusal to refund my amount of ₹2,25,000 despite repeated written and verbal communications.
Details of the Case:
- In March 2024, I initiated a home interior project with Livspace through their authorized dealership Eleven Associates, Delhi Road, Moradabad.
- On 30th June 2024, I paid a booking amount of ₹25,000 online.
- After a long delay of almost one year, the project remained in raw stage.
- Livspace employees — Ms. Richa (Mob: 7988249408), Mr. Sidharth Singh (Mob: 9873045062), and Mr. Akshay (Mob: 8630521029) — along with the Eleven Associates team, again approached me to finalize the designs.
- They informed me that 50% of the total project cost ₹8,60,000 must be paid to start production.
- On 30th May 2025, I paid ₹2,50,000 in cash to Eleven Associates (receipt attached).
- Thus, the total payment made to Livspace is ₹2,75,000, which is approximately 32% of the total cost.
- According to Livspace’s own policy, production cannot start before receiving 50% advance, yet Ms. Richa and her team falsely claimed that a “partial order was placed” to deny my refund.
- On 11th June 2025, a Livspace representative visited my Moradabad site for inspection, but soon after (15th June) I was transferred to Agra due to my job.
- On 21st July 2025, I requested cancellation and refund through Ms. Richa, but she denied, claiming false partial execution of the order.
- Later, my wife was diagnosed with gallbladder and kidney stones (14 mm) and had to undergo immediate medical treatment.
- On 3rd October 2025, I again contacted Livspace requesting refund due to medical emergency and offered to let them retain ₹50,000 as security, but refund the remaining ₹2,25,000.
- Despite multiple calls and follow-ups with Ms. Richa, Mr. Sidharth, and Mr. Akshay, as well as an email to Mr. Amman Mohammad (General Manager), no refund or written response has been received to date.
Grounds of Complaint:
- Breach of Trust and Misrepresentation: The team misled me by claiming partial order execution without receiving 50% advance, contrary to Livspace’s own policy.
- Unfair Trade Practice: Delayed project execution and refusal to refund despite no material or service delivery.
- Deficiency in Service: Failure to provide the promised interior service within agreed timelines.
- Mental Harassment and Financial Loss: The situation has caused severe stress and financial burden during my medical emergency.
Relief Sought:
- Immediate refund of ₹2,25,000 (Rupees Two Lakh Twenty-Five Thousand Only) paid to Livspace / Eleven Associates.
- Interest at 12% per annum on the above amount till actual refund.
- Compensation for mental agony, harassment, and financial loss caused by the respondents.
- Appropriate legal action against Livspace India Pvt. Ltd. and its dealer Eleven Associates, Moradabad for misrepresentation and unfair trade practice.
