Complaint Under Section 35 of the Consumer Protection Act, 2019

Facts of the Case:

  1. I have approached the Opposite Party, a home interior service provider LivSpace , for interior design and execution services for his/her residence located at [Kharadi , Pune].
  2. On [March 2023, I had paid an advance amount of ₹25000 to Livspace as per their quotation/agreement for initiation of the project. The payment was made through [Payment Method –Credit Card], and the ProjectID is [2180200].
  3. Due to some circumstances , we could not start this project and we did not get any service from Liv Space.
  4. Despite repeated follow-ups via phone, email, and messages, the Opposite Party failed to refund my advance amount
  5. I have requested a refund of the advance amount. However, the Opposite Party has failed to refund the amount despite several follow-ups, thereby causing mental harassment, loss of time, and financial stress.

Reliefs Looking from Honorable :

a) Direct the Opposite Party to refund the advance amount of ₹[25000] with 12% interest per annum from the date of payment till realization.
