Hello @vinay

I'm sorry to hear about the challenges you've faced with the Jharkhand State Housing Board regarding the surrender and refund of Flat LIG289. Your situation, as detailed above, highlights significant issues concerning the quality of the allotted flat and the subsequent refund process.

📝 Summary of Your Complaint

  • Flat Details: LIG289, allotted through the Housing Board's lottery system.
  • Issues Faced:
    • The flat was occupied by Housing Board staff for approximately six months post-allotment.
    • Upon possession, the flat was in poor condition: seepage due to drainage issues, non-functional electrical wiring, inadequate sanitation facilities, and overall substandard construction.
    • You invested around ₹3 lakh in repairs to make the flat habitable.
  • Refund Process:
    • Despite surrendering the flat and submitting all necessary documentation, no refund has been received to date.
    • The Housing Board has indicated a 25% deduction on the refund amount, which you contest given the circumstances.

✅ Recommended Actions

  1. Document All Communications:
    • Maintain a comprehensive record of all interactions with the Housing Board, including letters, emails, and any official correspondence.
    • Ensure you have copies of all documents submitted during the surrender process.
  2. Send a Legal Notice to Jharkhand State Housing Board:
    • Draft a detailed Legal Notice outlining the issues faced, the inconvenience caused, and the financial loss incurred.
    • Request a refund or compensation for the deficient service.
    • Send this complaint via Registered Post Acknowledgment Due (RPAD) to ensure proof of delivery.
  3. Approach the Consumer Court:
    • If the issue remains unresolved, consider filing a case in the consumer court.
    • You can file a complaint online through the E-Jagriti portal.
    • Required documents typically include:
      • Affidavit
      • Memo of Parties
      • Index
      • List of Events
      • Supporting documents (e.g., Aadhar card, payment receipts, photographs of the flat's condition)

📌 Additional Tips

  • Ensure that all your communications are clear, concise, and factual.
  • Keep copies of all documents and correspondence for your records.
  • Follow up regularly with the concerned parties and document all interactions.
