I purchased online AMC service from Eureka Forbes RO water purifier worth INR around 4654 INR, from them website (Healthy Living Made Affordable | Up to ₹2200 off on Exchange*| Live Now | Eureka Forbes)
My unit was not working then I book service request.
Service request number ( CM-110425-48664497 ).
I tried to reach company customer care but not provided solution regarding to visit technician for repair my RO system. I try to reach even local service center but they demanding more money then they repair system. I raised request for return my AMC paid amount but company refuse to paid back. If they give repairing service I want this. If you require then I give call history. Mail communication from customer care. What's app communication from company person. But not give my money back or even solution.

Mail generate many time.
Online application compliant many time.
But not responding for solution.

We have reviewed your detail concerning the lack of response from Eureka Forbes following the purchase of an Annual Maintenance Contract (AMC). Such inaction constitutes a clear case of deficiency in service under the Consumer Protection Act, 2019.

Legal Grounds:

According to Section 2(11) of the Consumer Protection Act, 2019, "deficiency" refers to any fault, imperfection, shortcoming, or inadequacy in the quality, nature, or manner of performance required to be maintained by or under any law or contract. Failure to provide services as stipulated in the AMC falls squarely within this definition.

Recommended Actions:

1. Issue a Legal Notice:

  • Send a formal legal notice to Eureka Forbes, demanding immediate fulfillment of the AMC terms or a full refund.

2. File a Complaint with the Consumer Forum:

  • If there is no satisfactory response within 15 days, file a complaint online with your nearest Consumer Disputes Redressal Commission. You can seek compensation for the deficiency in service, including any financial losses and mental agony suffered.

Documentation Required:

  • Copy of the AMC agreement or receipt.
  • Records of all communications with Eureka Forbes (emails, messages, call logs).
  • Any other relevant documents supporting your claim.

1. According to Complainant, he had purchased Water purifier model Reviva manufactured by OP and has been regularly paying for AMC since its purchase. Last AMC valid for 2 years was purchased online by paying Rs.7,950/- and was valid from 15.04.2019 to 14.04.2021. It is stated that the said Product has not been functioning properly since early July 2019 and below mentioned complaints were lodged by the
complainant:

Both the above complaints were attended but no improvement was seen in the product. The Complainant again reached out to customer care of OP on 11.09.2019 and subsequently sent 5 reminders (Total 6 emails), but there was no acknowledgement/response from the OP, though the complainant admitted that he did receive 2 phone calls on 17.09.2019 from the OP at Delhi and on 19.09.2019 from the OP based at Mumbai. Both callers promised to have the complaint attended within 24 hours. But no one from OP company has shown up or followed up the complaints. Consequent to gross indifference by the OP towards its regular customers and in spite of having paid good money towards the AMC of the product, complainant had to switch to boiling of water for drinking purpose on cooking gas cylinder. This is major inconvenience and loss in terms of both time and money.


OP is directed to refund only the AMC cost of Rs.7950/- along with interest @ 7% from the date of filing of the complaint ill final realisation to the complainant. The OP shall also pay a sum of Rs.2,500/- as litigation expenses to the complainant. Let this order be complied with by the OP within thirty days of receipt of copy of this order.

The brief facts of the complaint in a nutshell is as here under:-

It is stated in the complaint that, the complainant purchased a product which is Forbes Regeneration Media (Salt) for Rs.57,990/- vide invoice No.123290126803 and maintenance and repair services (Annual Maintenance Contract) from opposite party for Rs.5,500/-. The product which has been purchased by the complainant has stopped working, despite repeated attempts to seek assistance and reminders, no action has been taken to address the malfunctioning water softener. Also the Annual Maintenance Contract purchased has not been honoured.
Complaint has been raised by complainant (Complaint No.CM-050124-23484103). The complainant has mentally harassed from opposite parties as he did not get proper service from opposite parties end. That being deprived of the facilitated service complainant intimated opposite parties on several occasions by way of telephonic conversations and emails in respect of the above mentioned. For this malafide act complainant had to spend money on 25 liters of water filter can for drink water in his house. Even the complainant raise complaint repeatedly in emails and to the consumer care number.


:: ORDER :

The opposite party shall refund Rs.63,490/- to the complainant along with interest at 8% p.a from the date of this complaint after collecting the product from the complainant within one month from the date of this order. Failing which the opposite party is liable to pay the interest at the rate of 10 % p.a. on the said amount from the date of this order till its payment.

The opposite party is also liable to pay Rs.8000/- compensation towards mental agony caused to the complainant by way of deficiency of
service and unfair trade practice and Rs.4,000/- being the litigation costs within one month from the date of this order.

Failing which the said amount shall carry interest at 8% p.a. from the date of this order till its payment.
