COMPLAINT

I am filing this complaint regarding serious deficiencies in the food-delivery services provided through Swiggy by the concerned McDonald’s outlet.

Under Order ID 248109084119001, I specifically ordered vegetarian food. I am a strict vegetarian. However, instead of the vegetarian food ordered, I received a chicken/non-vegetarian item. The item also had a very unpleasant smell. Receiving non-vegetarian food despite specifically ordering vegetarian food caused me considerable distress, discomfort and frustration and was completely contrary to my dietary choice and personal values.

Despite this experience, I placed another order through Swiggy from McDonald’s under Order ID 248113911192638, expecting the order to be fulfilled correctly. Unfortunately, this order was also delivered incomplete, resulting in further inconvenience, disappointment and frustration, particularly as I had ordered the food for immediate consumption and was left without the complete meal that I had paid for.

Thus, two consecutive orders were improperly fulfilled. I contacted Swiggy customer support and communicated the seriousness of the matter. However, the responses primarily involved apologies, refunds/coupons and assurances rather than providing a satisfactory explanation or concrete corrective action.

I am not seeking merely a refund of the deficient items. My grievance concerns the repeated failure to provide the service that I paid for, the delivery of non-vegetarian food against a specifically vegetarian order, the resulting distress and inconvenience, and the inadequate handling of the complaint.

RELIEF SOUGHT

I respectfully request the Hon’ble Consumer Commission to:

  1. Direct the opposite parties to provide appropriate redressal/compensation for the deficiency in service and inconvenience caused.
  2. Direct the opposite parties to investigate both orders and determine responsibility for the failures.
  3. Direct appropriate corrective measures to prevent recurrence, particularly regarding vegetarian orders.
  4. Consider the repeated nature of the service failures and the distress and inconvenience caused while determining appropriate relief.
  5. Grant any other relief deemed appropriate in the facts and circumstances of the case.

I have preserved the relevant order records, invoices, photographs, packaging details and customer-support communications and can submit them as evidence.

I request that this complaint be duly considered and appropriate relief be granted.
