COMPLAINT UNDER SECTION 35 OF THE CONSUMER PROTECTION ACT, 2019

MOST RESPECTFULLY SHOWETH:

  1. PARTIES TO THE COMPLAINT:
    • That the Complainant is an individual residing at Satbankura, Paschim Medinipur, West Bengal, and the father/guardian of master Shreyansh Ghosh (Registration No. 23143767).
    • That Opposite Party No. 1 (PhysicsWallah Limited) is an educational service provider running coaching programs, and Opposite Party No. 2 (Lord Krishna Finance) is its financial/lending partner facilitating fee payments via installment/loan options.

  1. BACKGROUND & ADMISSION CANCELLATION:
    • That the Complainant enrolled his son, Shreyansh Ghosh, in the 2-Year program at Physics Wallah Vidyapeeth (Kharagpur Center).
    • Due to severe health issues/physical weakness, the student was unable to attend classes. Pursuant to medical advice, the Complainant formally submitted an Admission Cancellation and Security Deposit Refund request along with all required supporting medical documents issued by Dr. Ranjit Kumar Bisai.
  1. WRITTEN CONFIRMATION & APPROVAL BY OP NO. 1:
    • That Opposite Party No. 1, after evaluating the submitted medical documents, formally accepted and processed the request as follows: a) Admission Cancellation Confirmation: Issued via Email / Ticket ID 1146851 dated June 19, 2026. b) Security Deposit Refund Processing: Issued via Email / Ticket ID 1187795 dated July 7, 2026.
  1. UNFAIR TRADE PRACTICE & DEFICIENCY IN SERVICE:
    • That despite the formal written cancellation of admission on June 19, 2026, Opposite Parties failed to close the underlying financial/loan arrangement and stopped neither the unauthorized collection calls nor the illegal auto-debits.
    • That recovery agents calling from unknown third-party numbers continued demanding the full 2-year package fee and sending WhatsApp payment links without issuing proper written statements.
    • That Opposite Party No. 2 unlawfully executed auto-debit deductions/EMI debits on 31.07.2026, 02.08.2026, 05.08.2026, 05.09.2026 and 05.10.2026 even after the admission stood fully cancelled.
  1. LEGAL ISSUES & PRECEDENTS:
    • That retention of full fees or forcing installment payments for services not rendered post-cancellation constitutes Deficiency in Service under Section 2(11) and an Unfair Trade Practice under Section 2(47) of the Consumer Protection Act, 2019.
    • That internal coaching institutional policies prohibiting refunds or forcing non-cancellation cannot override statutory rights under the Consumer Protection Act or binding rulings of the Hon'ble NCDRC and Supreme Court of India.
  2. LEGAL NOTICE & NON-COMPLIANCE:
    • That the Complainant issued formal legal notices/reminders and raised NCH Grievance #9878177, demanding immediate closure of the loan account, refund of security deposit, and stopping of auto-debits. However, the OPs failed to resolve the grievance and provided generic administrative responses.
  3. JURISDICTION & LIMITATION:
    • That the cause of action arose within the jurisdiction of this Hon'ble Commission as the Complainant resides in Paschim Medinipur, and transactions/communications took place within this District. The complaint is filed well within the prescribed period of limitation.
PRAYER

In light of the facts and circumstances stated above, the Complainant most respectfully prays that this Hon'ble Commission may be pleased to:

  1. Direct Opposite Party No. 1 and No. 2 to immediately terminate/close the loan account linked to Student Reg. No. 23143767 and revoke all active NACH/ECS/auto-debit mandates.
  2. Direct Opposite Parties to refund the complete Security Deposit amount along with reimbursement of all unauthorized EMI debits executed post-cancellation (including debits made on 31.07.2026, 02.08.2026, 05.08.2026) along with interest @ 12% per annum.
  3. Direct Opposite Parties to issue a formal No-Dues Certificate to the Complainant.
  4. Award Compensation of ₹1,00,000/- (Rupees One Lakh only) towards mental agony, harassment, and distress caused to the Complainant and his family.
  5. Award Litigation Costs of ₹20,000/- (Rupees Twenty Thousand only) to the Complainant.
  6. Pass any such further order(s) as this Hon'ble Commission may deem fit and proper in the interest of justice.
