Subject: Legal Notice – 15 Days’ Notice Prior to Initiation of Proceedings under Consumer Protection Act, 2019 and Applicable Laws.
Dear Sir/Madam,
I, Mention Your Name, hereby serve upon you this legal notice as under:
1. That I had purchased a NO-Year Travel Membership from your company on date, bearing Membership ID NO, upon payment of ₹amount, relying upon the representations, assurances, advertisements, and promises made by your company represntative over the call and in the event organised by you at Venue Name and Address, regarding provision of travel-related services including accommodation bookings and allied benefits.
2. That it is now evident that the representations made by your company staff were false, misleading, and deceptive, and were made solely to induce me to purchase the said membership.
3. That despite repeated requests made by me through customer care calls and emails for booking travel services, your company has failed, neglected, and deliberately avoided providing any services, thereby rendering the membership completely useless.
4. That your aforesaid acts and omissions amount to:
Deficiency in service** under Section 2(11) of the Consumer Protection Act, 2019;
Unfair trade practice** under Section 2(47) of the Consumer Protection Act, 2019;
Cheating** within the meaning of Section 415 punishable under Section 420 of the Indian Penal Code;
Misrepresentation and fraudulent inducement**, attracting both civil and criminal liability.
5. That due to your unlawful conduct, I have suffered financial loss, mental agony, harassment, and inconvenience, for which you are liable to compensate me.
Accordingly, you are hereby finally called upon to:
a) Refund the entire membership amount of ₹amount along with interest @ 18% per annum from the date of payment; and
b) Pay compensation of ₹5,00,000/- towards mental agony, harassment, and costs.
You are hereby granted 15 (fifteen) days from the date of receipt of this notice to comply with the above demands.
Failing which, I shall be constrained to initiate appropriate legal proceedings against your company before the Hon’ble Consumer Disputes Redressal Commission, as well as initiate criminal proceedings under applicable provisions of law, entirely at your risk as to costs and consequences, without any further notice.
This notice is issued without prejudice to all my legal rights and remedies available under law.
