1. Customer & Purchase Details
Customer: Shafreen banu
Vehicle: Ola Electric Scooter
Purchase Date: 17 November 2023
Purchase Location: Mangalore, Karnataka
Customer's present residence: Vorkady, Manjeshwar, Kasaragod, Kerala – 671323
RC/Aadhaar address: Puttur, Karnataka
Total amount invested: Approximately ₹1,70,271
Amount paid
- Ola scooter: ₹1,62,012
- 8-year extended warranty: ₹8,259
- Ola Care Plus purchased separately on two occasions: approximately ₹4,129 each
2. Main Problem
The scooter has suffered repeated and serious technical problems from the early period of ownership.
The major issues include:
- Scooter not starting/moving
- Charging problems
- Battery completely draining
- Scooter stopping unexpectedly while being used
- Sensor-related malfunction
- Scooter unexpectedly starting/moving due to the reported sensor issue
- Motor replacement was carried out once, but the problem was not permanently resolved
- Repeated faults continued even after the motor replacement
- Scooter has become practically unusable for a prolonged period
The vehicle has travelled only approximately 31K km, despite being purchased in November 2023.
3. Repeated Complaints to Ola
I have contacted Ola repeatedly through:
- Customer-care calls
- Emails
- Service/RSA requests
- National Consumer Helpline complaint
- Other follow-ups
There have been more than 30 complaints/follow-ups regarding the vehicle and service issue.
Despite repeated complaints, the problem has not been permanently resolved.
Ola has repeatedly provided generic instructions such as:
«“Bring the vehicle to the nearest service centre.”»
However, there has been a serious practical problem in obtaining timely service from my location.
4. Service-Centre Problem
My residence is at Vorkady, Manjeshwar, Kasaragod – 671323.
Ola customer care repeatedly informed me that there was no Ola service centre within approximately 50 km of my location / no service facility available in my pincode.
Despite repeated requests, I did not receive a proper appointment date or timely service solution.
I also made RSA/service requests, but the expected assistance was not effectively provided.
Eventually, I personally had to take the scooter to the Ola service facility at Padil, Mangalore, despite the considerable distance and inconvenience.
This is particularly relevant because a recent Kasaragod Consumer Commission Ola case involved a customer who had to travel approximately 100 km to Mangalore for service.
5. Warranty / Ola Care Issue
The initial problems arose while the applicable Ola Care/warranty support was active.
I had also purchased an extended warranty of approximately ₹8,259 for 8 years.
Ola Care Plus was purchased separately on two occasions at approximately ₹4,129 each.
During the period when I was repeatedly trying to obtain service/RSA assistance, the Ola Care Plus period expired.
I believe the failure to provide timely service despite repeated requests should not be used against me merely because the support period subsequently expired.
6. Financial & Personal Loss
I purchased the Ola scooter primarily because I needed reliable transportation for commuting and wanted to reduce fuel expenditure and pollution.
Before purchasing the Ola scooter, I had a Suzuki Access 125, which I sold after deciding to purchase the EV.
My employment required regular travel between my residence and Mangalore. The approximate daily commuting distance was around 60 km.
The Ola scooter was purchased specifically to reduce petrol expenditure and provide reliable daily transportation.
Instead, the scooter has remained unusable/non-functional for a prolonged period.
I have therefore suffered:
- Loss of use of the vehicle
- Transportation/alternative travel expenses
- Loss of time
- Repeated travelling/follow-up expenses
- Mental agony and inconvenience
- Financial loss
- Failure to receive the benefit expected from the vehicle and extended warranty
- Loss of confidence in the product and service
7. Extremely Low Usage
Despite purchasing the vehicle on 17 November 2023, the scooter has travelled only approximately 31K km.
This is important evidence that the vehicle has not been reasonably usable.
The purpose of purchasing the vehicle was daily transportation, but it has failed to provide that basic purpose.
8. Present Position
The issue has continued for a very long period despite repeated approaches to Ola.
My position is that I do not want another indefinite repair cycle or generic customer-care response.
I require either:
Primary relief
Refund of the amount paid for the scooter and associated warranty/service expenditure, along with appropriate compensation, litigation expenses and other legally permissible relief.
Alternative relief
If the advocate considers it legally appropriate, Ola should first be given a strict and final opportunity to provide a proper nearby service solution within a defined period, with all defects permanently rectified.
If Ola fails again, I want to proceed for refund and compensation.
I can provide:
1. Vehicle invoice
2. RC copy
3. Aadhaar/address documents
4. Extended warranty documents
5. Ola Care Plus records
6. Payment records
7. Service invoices/job cards
8. Motor replacement records
9. Customer-care complaint numbers
10. Email correspondence with Ola
11. RSA requests
12. National Consumer Helpline complaint/response
13. Photos/videos of the vehicle faults
14. Service-centre records
15. Call records/screenshots where available
16. Proof of residence at Manjeshwar
17. Evidence of travel to Mangalore/Padil for service
18. Any communication where Ola stated that there was no nearby service centre
My objective
My objective is to obtain a legally justified refund/compensation for a vehicle that has been practically unusable despite repeated complaints and attempts to obtain service, rather than continuing indefinitely with repeated repairs and generic customer-care responses.
