Neha Mehta purchased a dress Nirmoha Geometric Print Kurta Set with Dupttta from Ajio by placing an online order for a sum of Rs.40810/-; that the delivered dress to the Neha Mehta was not fit in size, therefore, the same was sent back to the same courier service from which it was received; that after receiving the dress back the Ajio acknowledged the same and assured that the amount of Rs.48010/- would be refunded soon but till today no amount has been paid to the Neha Mehta despite several requests. The act and conduct of the Ajio clearly amounts to deficiency in service and unfair trade practice on its part.
Commission is of the considered view that the present complaint deserves acceptance because the Ajio has indulged in the unfair trade practice as well as disservice to the Neha Mehta, as discussed above. Accordingly, present complaint with a direction to the Ajio to pay Rs.40810/- (Rs.Forty Thousand Eight Hundred and Ten only) alongwith interest @ 7 % per annum from the date of filing of the complaint till its realisation. Further allow Rs.1 1,000/-, (Rs.Eleven Thousand) in lump sum, towards mental harassment and agony suffered by the Neha Mehta and also towards litigation expenses.
