Unethical business practise - refund amount being withholding

Dear Sir/Madam,
I am writing to you with regards to the dental aligners service which I had signed up with Toothsi MakeO via online app on 14th Nov’25.

Post showing interest there was a representative sent to my residence who scanned my teeth and suggested a plan worth 55000 for a duration of 7-8 months and around 27 set of aligners. For this he suggested I make a payment of Rs 55000 which I did with an emi option with my credit card. He mentioned to me that it would take a minimum of 30 days to deliver the aligners from Mumbai. I got a buddy Binay assigned and he promptly explained the process to me also asking me to get a tooth cleaning mandatorily done before I get started. For few days post payment he kept calling and explaining the same process but after a few calls they stopped calling.

Post one month I received a trial pack with one set of trial aligners. However, nobody from Toothsi customer care or my assigned buddy ever called me. When I reached my buddy he mentioned that I will need to visit their clinic at BEL road, Bangalore. He helped me with the appointment for 5 th Dec’25.

When I met the assigned doctor - Daphne Fernando, she said the trial kit fit me perfectly and that she would raise the request for the actual aligners immediately. She asked me to wear them continuously for 22 hours and that these pairs would last for 15 days. I waited for a week to hear back from them but since new kits take time of around a month I got worried that I had already worn the temporary set for a week and there was no news about new aligners I called up their customer care. To my surprise the person I spoke to had no clue about what was happening and she kept asking me questions like - do you need to order the aligners and if I had completed my clinic visit. This was very frustrating as they have an app which tracks everything but yet nothing was clearly updated anywhere and the customer care di not care. I Keot making repeated calls over the next few days but each time the person over phone would start from scratch explaining the process and I understood that they had taken me for a ride. I had already paid my first emi instalment amount of ₹9000 and with no news of what happens next. Post a week when I could no longer take this I raised a call for cancellation and the customer care person suggested I raise it over their app which I did on 9th Dec’25. The app stated that within 7 days someone would contact me.

I waited for a week and got no calls. I grew suspicious and called their customer care who were not even aware that I had raised a cancellation request. They kept on asking me the same set of questions about what they can do over the next few days and one suggested I write to their customer care over email, which I did. After this my assigned buddy called if he could help but started asking if I had visited the clinic which again surprised me and chose to stick to my decision to proceed with cancellation. Binay said that I cannot get any refund since the procedure had already started and the production was also started for the aligners. I had to scold him stating that Daphne had called the earlier day who apologies for her mistake in not raising the request for the production of aligners further post the trial kit and she also tried to convince me saying that she is the zonal head and that she would personally look into my case but I chose not to continue with them. My buddy Binay suggested that I speak to his superior and I was connected with some Rakesh who asked me all sort of questions and tried to convince me to not cancel and that he would immediately place the aligners kit order. Again I did not change my decision post which he said he will proceed with the cancellation which would take around 15 days.

Post 15 days when I heard nothing I tried calling them and dropped an email querying about my cancellation and refund. Soon I got a call from Rakesh who again tried convincing me to continue and when I told him I will not he said he will raise the cancellation from his end and that 15 days would’ve required minimum for the refund. Until now I have not got a single response to my mails or calls and there is no sign of any refund. I have only paid my second emi instalment for a bunch of lies and cheaters with no intention of providing refund.

I am not sure about the ratings but since this is a reputed brand I had gone with them.

Request you to help me with my refund and end this ordeal.

From the facts, it appears that the you have paid ₹55000/- to the Toothsi.

I waited for a week and got no calls. I grew suspicious and called their customer care who were not even aware that I had raised a cancellation request.

They have failed to provide the promised service.

In such situations, once the service is not delivered within a reasonable time, the service provider is expected to act fairly and return the amount. Retaining the consumer’s money without justification amounts to unfair conduct and causes financial loss and mental harassment.

Consumer forums have consistently held that withholding refund without valid reason is unjustified, especially when the service is not provided or the terms are not fulfilled.
Further, practices like “no refund” or arbitrary deductions cannot override the basic rights of a consumer when there is clear deficiency or failure in service.


Until now I have not got a single response to my mails or calls and there is no sign of any refund.

As they are not responding your email, you need to file a case against them.
