Subject: Complaint Against PlanetSpark – Refusal to Honour Refund Assurance and Unfair Trade Practice
I wish to lodge a complaint against PlanetSpark for refusing to honour the refund assurance given to me at the time of enrolment and for their complete lack of response despite repeated follow-ups.
On 10 July 2026, I enrolled my 12-year-old daughter, Vihana Baid, in PlanetSpark’s online communication course after speaking with their counsellor. Before making the payment, I specifically asked what would happen if my daughter did not like the classes or was unable to continue.
The counsellor clearly assured me that there would be an observation period of 5 classes and that if we decided to discontinue within those initial classes, the unused amount would be refunded after deducting charges for the classes attended. Relying entirely on this assurance, I paid ₹1,05,000 for the course.
Unfortunately, after attending only 3 classes, it became evident that the program was not suitable for my daughter. She was uncomfortable with the online format and did not wish to continue. We immediately informed PlanetSpark and requested cancellation and a refund within the very first week itself.
Since then:
- My daughter has attended only 3 classes.
- She has not attended a single class for over 20 days.
- We have repeatedly requested cancellation and refund through emails and customer support.
- Despite numerous reminders, PlanetSpark has largely stopped responding to my emails.
After persistent follow-ups, PlanetSpark finally offered a partial refund of ₹40,000 while retaining ₹65,000 and forcing us to continue with the remaining classes, even though my daughter has no intention of attending them.
This is completely unfair because:
- The refund assurance given before enrolment has not been honoured.
- We requested cancellation almost immediately after enrolment and within the promised observation period.
- My daughter has not used the services beyond the first 3 classes.
- The company is retaining a substantial amount without providing any meaningful service.
- Their repeated failure to respond to my emails amounts to poor customer service and causes unnecessary mental stress.
I believe this amounts to misrepresentation, unfair trade practice, and deficiency in service under the Consumer Protection Act.
I respectfully request the Consumer Forum to:
- Direct PlanetSpark to provide a full refund, after deducting reasonable charges only for the 3 classes actually attended, if applicable.
- Investigate the misleading assurances given during the sales process.
- Ensure that other parents are not subjected to similar practices.
I have preserved all supporting documents, including:
- Payment receipts.
- Email correspondence.
- PlanetSpark’s written offer of a ₹40,000 refund.
- Screenshots of conversations and follow-up emails.
- Details of the assurances made during enrolment.
I request your kind intervention to help resolve this matter fairly.
